GTC SAVA Health & Training

The following General Terms and Conditions (hereinafter referred to as GTC) represent the contractual terms between SAVA Health & Training GmbH (hereinafter referred to as SAVA) and its customers (hereinafter referred to as Customers):

1. Scope of application

All services provided by SAVA are subject to these terms and conditions in their entirety, unless they have been amended or supplemented by written agreements.

 

SAVA reserves the right to change these GTC at any time. The version of these GTC valid at the time of conclusion of the contract shall be decisive.

2. Scope of services

SAVA offers customers individual and health-promoting training programmes that can be used by anyone, provided there are no medical concerns.

3. Health questionnaire

The health questionnaire with information on your state of health and objectives must be completed fully and truthfully before starting your first training session. Furthermore, the accuracy of the information must be confirmed with a personal signature. This is mandatory for SAVA's protection. The personal information collected will be treated confidentially and used to design training that is as individual and efficient as possible.

4. Health

Any current illnesses or changes in health that could affect training must be reported to the trainer before training begins. If you have not exercised regularly in recent years, are not in perfect health and/or have had a serious illness in the last two years, a medical examination is recommended before starting training. However, any associated medical examination or preliminary examination is entirely the responsibility of the customer and not the responsibility of SAVA.

 

The training and coaching are provided with great consideration for health, but SAVA does not guarantee that the content is correct and appropriate for the specific health needs of the customer.

5. Prices

The current price list published on the website applies and forms part of the contractual agreement with the customer. Prices include any applicable statutory value added tax (VAT) and are quoted in Swiss francs (CHF). SAVA reserves the right to adjust prices. The prices published on the website on the date of purchase apply to customers.

6. Subscription

A subscription is personal and non-transferable. The validity period (term) of the respective subscription is based on the duration specified on the website. After expiry of the term, the entitlement to training sessions not yet taken expires. SAVA must be notified of any holiday absences during the term as early as possible so that the subscription can be paused during this period. Subsequent notifications will not be taken into account.​​​

7. Payment terms

For subscriptions, the full amount must be paid either by bank transfer or in cash within 14 days of the invoice date. Other training options (e.g. individual training sessions) must be paid for in cash, by Twint or by card on the day of training. Payment methods for online purchases are listed on the website.

 

 

8. Training sessions

The customer shall agree the date and time of each training session with SAVA in person, by telephone or by message. All such agreements are binding. If the customer is unable to attend, they are obliged to cancel the appointment at least 24 hours before the start of the training session by message, email or telephone, otherwise SAVA shall charge the customer the full price of the training session.

9. Course cancellations and changes

We reserve the right to make changes to the small group course schedule, the services offered or the trainers, to an extent that is reasonable for the customer, and such changes do not entitle the customer to a reduction in the contract price or to reclaim any payments made. This does not apply to any cancellations on the part of SAVA due to unforeseeable incidents, such as the short-term absence of a trainer due to illness or insufficient number of participants.

10. Absence

Failure to make use of SAVA's contractual services does not entitle the customer to a reduction in the contract price, to make up for the training session(s) after the end of the term, or to reclaim payments made.

11. Commencement, duration and termination of contract

The contract becomes legally binding upon written signature, verbal agreement or online purchase. The period of validity is determined by the contract. The contract ends without termination upon expiry of the agreed term. The customer may apply to SAVA for early termination of the contract and a (partial) refund in cases of hardship, such as prolonged illness or accident, which SAVA will then review in good faith.

12. Termination of contract by SAVA

Every SAVA customer is obliged to follow the instructions of SAVA's supervisory staff (e.g. trainers) and to strictly comply with hygiene regulations and house rules. If one or more of these points are not complied with, SAVA is entitled to terminate the current contract with immediate effect. In this case, the customer shall also have no claim to a refund of the (remaining) amount. Early termination of the contract by the customer is not possible.

13. Liability

Each customer is responsible for their own insurance cover and for taking out accident insurance. SAVA accepts no liability for damage resulting from an accident, injury or illness in connection with training or the use of the equipment and all facilities. Furthermore, SAVA is not liable for the loss of valuables, money, clothing, etc. before, during and after training.

 

If SAVA Health & Training is unable to provide its services due to force majeure (fire, earthquake, water, epidemic, etc.), there shall be no entitlement to compensation or reimbursement. In this case, SAVA shall seek alternative solutions for the customer.

14. Data protection

The customer's personal data will be stored by SAVA and used exclusively for the fulfilment of the aforementioned service. The stored data will be deleted upon request after the last training session.

15. Amendments to the GTC

The customer acknowledges that SAVA may amend these GTC at any time. Relevant amendments shall be communicated to the customer in an appropriate manner.

16. Applicable law, place of jurisdiction

All legal relationships between the customer and SAVA are governed by Swiss law.

 

The place of jurisdiction is Zurich, Switzerland.
